Course objectives
The course offers information about the basic legal terminology and enables orientation in Czech law. The contents of the course are selected chapters from public as well as private law. Lectures as well as seminars are a part of the course. The lectures give basic information concerning the course topics. The seminars offer space for discussion and practice by the means of solving practical problems, work is conducted in small groups of students. A course graduate should know and understand legal and institutional context of social work, master basic knowledge of Theory of Law, and Constitutional, Family, Civil, Labour and Criminal Law. The student should have understood the functional mechanics of law and its limitations. New knowledge from the key areas of law should be received by the means of discussion and concrete examples. Thus the student not only gets theoretical knowledge, but also ability to solve basic practical problems of clients in the area of social law.
Syllabus
  • 1. Basic Concepts of Justice: The concept of law, functions of law, legality, legal knowledge, sources of law, public and private law, legal standards, the types of legal norms, interpretations of laws, different areas of law, legal relationships, legal negotiations, the infringement acts, barring and the preclusion, application of the law 2. Constitutional Law: The concept, sources, characteristics and content of the Constitution, the Constitution of the Czech Republic: basic provisions, legislative power, executive power, judicial power, the Supreme Audit Office, Czech National Bank, Charter of fundamental rights and freedoms: cathegories of freedom 3. Administrative Law: The concept, object sources, municipalities, public authorities and municipalities, public administration, government, regions, administrative proceedings, complaints, notifications and incentives offences, the management of the offences, Czech system of governance 4. Judiciary, public prosecutors' offices, advocacy, notary's office 5. Civil Law: The bodies of representation, contracts, property ownership, rights in rem to things foreign, obligations, commitment acts, illegal acts commitments, liability 6. Heirship: Assumptions of succession, inheritance of property, features, the basic principles of inheritance law, successions, the management of heritage 7. Civil Proceedings: The concept, parties and persons involved in the proceedings, the initiation of proceedings, the course of proceedings, evidence, the decision costs, remedies, enforcement. 8. Family Law: The concept, sources, marriage, parents and children, the determination and denial of family, community participation in the exercise of rights and duties of parents, alternative education: adoption, foster care, the delegation of the child to education than any other citizen, parent, a constitutional education, maintenance obligations: concept species 9. Labour Law: The concept, bodies, sources, employment, working hours, rest periods, health and safety at work, pay, special working conditions, an agreement on work performed outside employment, damages, trade unions, collective bargaining 10. Criminal Law: The concept, functions, the basic principles of criminal law, the foundations of criminal liability, elements and characteristics of an offence, legal consequences of criminal liability, special parts of criminal law, criminal procedure, the bodies of criminal proceedings, the conduct of criminal proceedings

Teaching methods
Lectures, seminars, study of legal norms, discussion, practising by the means of solving concrete examples from practice, work in small study groups, homework.
Assessment methods
Seminar attendance. Handing-in homework on continuous basis is an exam requirement. Written exam (open and closed questions). To pass the exam, students need to get minimum of 65% points.
