- Course objectives
- The aim of the course Civil law I is, on the level corresponding with this program, to give to the students the knowledge of the basic characteristics of civil law, incl. its position in the system of legal order and its internal system, the knowledge of principles, rules and issues of civil law and its most general institutes in the frame of juridical facts. The accent is given to the comparative methode, especially from the point of view of EU law.
- Learning outcomes
- Student will be able, after the course:
- to identify ón the scientific level and with the scientific argumentation the basic criteria of the identification of private law and its differences from public law
- to provide the analysis of internal structure of private law as the general private law and the "special private laws";
- to apply, on both theoretical and practical grounds, the rules, principles and further sources of private law;
- to make the systemic analysis, to formulate the concept of judgement incl. the relevant argumentation in the "hard cases";
- to incorporate into model judgements the judiciary of ECJ, Constitutional Court and European Court of Human Rights;
- to elaborate concept of solutions, based on both theory and practice of juridical/legal facts. - Syllabus
- 1. The basic concept of civil law. 2. The position of the civil law in the whole system of legal order. 3. The internal system of civil law. 4. The principles of civil law. 5. The rules and sources of civil law. 6. Theory and practice of juridical facts. 7. Theory and practice of juridical individual acts. 8. Theory and practice of contract law. 9. The notion of the time in civil law.
