- Course objectives
- Arbitration, or the international arbitration is the private way used by merchants, companies or other private person for disputes, which arises form contracts with foreign element (foreign parties). The course is dealing with problems connected with this way of disputes resolution: origin and practise of arbitration, sources of arbitration, doctrines of arbitration, arbitration agreement, jurisdiction of the arbitral tribunal, applicable law, arbitration award.
- Learning outcomes
- At the end of the course student should be able: - to understand and to explain the theoretical foundation of the ADR; - to understand and to describe the development of the arbitration, especially international arbitration; - to explain the basic theoretical pillars of the international arbitration; - to compare the development of the arbitration in CR with the situation abroad; - to present reasoned arguments reflected different issues.

- 1. Introduction. 2. Agreement. Doctrines. 3. Jurisdiction of the arbitral tribunal. 4. The arbitral tribunal. 5. The arbitral procedure - the applicable law. 6. The award - foreign award, amendment and challenge of the award.
