- Course objectives
- Main goals of this course are following: to deepen knowlege of such branches of law as theory of law and filosophy of law; to clarify the framework of legal argumentation and arbitrariness; to specify the usage of selected metodhological procedures of legal logic and argumentation by means of both theoretical and practical examples; to learn the lege artis methodology of applied teleological interpretation; to consider rational reasining of moral judgment by means of discourse analysis (ethical kriteria of legal argumentation); to outline the algorithmic rule how to solve the situation of conflict of purposes of law.
- Syllabus
- The concept of arbitrariness and his typical features in legal practice (ad illustrandum analysis of selected cases). Argumentation and reasoning in the framework of evidentiary proceedings. Particularities of interpretative methods and of special legal logic arguments. Teleological interpretation. Judicial creation of law and its limits. Ethical criteria of argumentation.
