- Course objectives
- Mining law is an interdisciplinary area of law because it uses both public and private methods of legal regulation. At the same time, it also uses knowledge from various legal branches (especially administrative law, environmental law, civil law). Mining law institutes and their applications are very closely connected with the knowledge of the geology of mineral deposits, mining methods and the elimination of their impact on the environment, including the financial costs of implementing these activities. At present, there is no subject taught at MU that would deal in detail and comprehensively in the indicated context with the matter of mining law. The course is intended primarily for students of the Faculty of Law, which will enable them to deepen their knowledge of other subjects - such as land and civil law or environmental law. The target group is also students of other faculties who deal with the issue of the use of mineral wealth from illegal (factual) points of view: especially students of the Faculty of Science. Graduates of the course will be able to understand the basic concepts and institutes of mining law and explain them in relation to other branches of law; to present rational proposals for the solution of model examples; designate a decision-making body; independently process the necessary legal submissions according to the assignment and nature of the case; interpret the rules of mining law in accordance with the constant case law of the courts.
- Learning outcomes
- After completing the course, the student will be able to: - identify the legal problem associated with mining and/or reclamation of the mining area - apply legislation to a specific problem related to mineral extraction - to analyze the property relations of a specific mineral deposit - to propose basic legal steps in planning the reclamation of mining areas
- Syllabus
- 1. (lecture/seminar): Factual introduction: minerals, raw materials, deposit (geological types of deposits), reclamation and restoration of ecosystems, environmental aspects of the use of mineral wealth. 2. (lecture/seminar): Introduction to mining law: historical development, place of mining law in the system of law, conceptual tools. 3. (lecture/seminar): Exploration of mineral deposits and their protection; geological work. 4. (lecture/seminar): Permitting mining and carrying out mining. 5. (lecture/seminar): Property issues (including obtaining rights to land needed for mining); economic instruments. 6. (lecture/seminar): Elimination of the consequences of mining (reclamation, mining damage, old mining works).

- Teaching methods
- Interactive lectures to communicate the information needed to solve practical examples. The main part of the course will be seminars, where practical and model cases dealing with legal issues in the search for and use of mineral deposits and elimination of the consequences of mining will be solved in the form of a discussion. Students will prepare the solution of examples before the seminar. Teaching will take place in four-hour blocks once every fortnight (with the exception of teaching in the first week of the semester, when there will be only a lecture in the range of two teaching hours). There will always be a lecture and a seminar within the block. In total, the teaching will include 14 hours of lectures and 12 hours of seminars. The course will also include an excursion to a place near Brno, where mining and reclamation of the consequences of mineral extraction are taking place. During the excursion, the representatives of the practice will be professionally explained and documented the basic issues of mining and processing of minerals, solutions for land reclamation and economic issues. Students will also get acquainted with the legal documents on the basis of which mining takes place. Direct acquaintance with the course and consequences of mining activities will enable a better and more effective understanding of the relevant legislation (material sources of law) and its application.

- Combination of written and oral performance (discussion) carried out by students on the grounds of tasks assigned during semester. Final test.
