- Course objectives
- Mining law is an interdisciplinary area of law because it uses both public and private law methods of legal regulation. In doing so, it also uses knowledge from various branches of law (in particular administrative law, environmental law, civil law). The institutions of mining law and their application are very closely linked to knowledge of the geology of mineral deposits, methods of extraction and the elimination of their impact on the environment, including the financial costs of the implementation of these activities. The course is intended primarily for students of the Faculty of Law, for whom it will enable them to deepen their knowledge of other subjects - e.g. land and civil law or environmental law. The target group is also students of other faculties that deal with the issue of mineral exploitation from non-legal (substantive) aspects: mainly students of the Faculty of Science.
- Learning outcomes
- Graduates of the course will be able: to understand the basic concepts and institutes of mining law and explain them in relation to other branches of law; to present rational proposals for the solution of model examples; to identify the authority competent to make decisions; to independently prepare the necessary legal submissions according to the assignment and the nature of the case; to interpret the regulations of mining law in accordance with the constant case law of the courts.

- 1. lecture and seminar: introduction to mining - minerals, raw materials, deposits (geological types of deposits), reclamation and restoration of ecosystems, environmental aspects of mining 2. lecture and seminar: introduction to mining law - historical development, place of mining law in the legal system, conceptual tools. 3. lecture and seminar: prospecting for mineral deposits and their protection; geological works. 4. lecture and seminar: authorisation of mining 5. lecture and seminar: property law issues (including obtaining rights to the land needed for mining); economic instruments. 6. lecture and seminar: remediation of the consequences of mining (mine reclamation, mine damage, old mine workings).

- Teaching methods
- Interactive lectures to communicate the information needed to solve practical examples. A central part of the teaching will be seminars, where practical and model cases dealing with legal issues in the prospecting and exploitation of mineral deposits and the remediation of the consequences of mining will be solved through discussion. Students will prepare solutions to the examples before the seminar. Classes will be taught in four-hour blocks once a fortnight . The block always includes a lecture and a seminar. In total, the course will consist of 14 hours of lectures and 12 hours of seminars. The teaching will also include an excursion to a site in the vicinity of Brno, where mining and the removal of the consequences of mineral extraction are taking place. As part of the excursion, the basic issues of mining and mineral processing, solutions to reclamation of the area and economic issues will be professionally explained and documented by the representatives of the practice. The students will also get acquainted with the legal documents on the basis of which mining is carried out. Direct acquaintance with the history and consequences of mining activities will enable a better and more effective understanding of the relevant legislation (material sources of law) and its application. The e-learning is provided with an interactive syllabi, background materials in electronic form and links to various (also media) publicly available resources in electronic form.

- Combination of written and oral performance (discussion) carried out by students on the grounds of tasks assigned during semester. Final test.
