- Course objectives
- The aim of the course is to help students with processing their dissertation thesis (alternatively another expert outcome) if they find out (possibly in collaboration with a supervisor) that for the solution of their dissertation task it will be suitable, or rather necessary, to conduct a legal historical research and to study historical development in the examined area (often e. g. to find a teleological background of the examined institute). The effort may be directed straight to processing relevant legal historical chapter of the dissertation thesis, alternatively at least to a draft (an auxiliary text) which will not be fully incorporated into the final paper after all, however, it will help the postgraduate student to understand the solved topic correctly in its historical links and eventually, it will have an impact on processing high-quality individual chapters and on the conclusions contained in them. The particular specialization will be arranged individually. The purpose of the course is to familiarize postgraduate students with methods of conducting a research of legal historical sources of historical secondary literature, practice of courts and possibly primary sources. Alongside that, they will be alerted to methodological issues which they will have to deal with in particular historical periods. In case of an interest from the postgraduate student’s side, the guarantor of the course will provide the particular postgraduate student with individual consultation and methodological help.
- Learning outcomes
- After passing the course, the student will:
- be knowledgeable in available secondary literature (considering the historical development in the Austrian one as well) and in collections of historical sources,
- be familiarized with available bibliographies, collections of historical practice of courts, collections of legal regulations and with their availability on-line,
- know how to cite historical practice of courts and legal regulations correctly (especially in older periods) in order to avoid common mistakes in citations (e. g. incorrect marking of sources of law, collections of publications etc.),
- know what precisely to focus on during the writing (considering that on the territory of the Czechoslovakia, there were more legal orders in force simultaneously – legal dualism),
- be able to eliminate historical inaccuracies in a text with the potential help of an individual consultation followed by a critical examination of a legal historical chapter by a guarantor of the course. - Syllabus
