Measure of the Faculty of Law, Masaryk University No. 5/2021 Scholarship programmes of the Faculty of Law, Masaryk University (in the wording effective from 1st April 2021) In accordance with § 28 section 1 of Act No. 111/1998 Coll. on Higher Education Institutions and on Amendments and Supplements to some other Acts (the Higher Education Act), as amended (the "Higher Education Act"), in accordance with Masaryk University Scholarship and Bursary Regulations (hereinafter referred to as “Regulations of MU”), I hereby issue this Measure: Section one General Provisions Article 1 (1) This Measure announces scholarship programmes of the Faculty of Law, Masaryk University (hereinafter referred to as “the Faculty”) and specifies conditions and procedures applicable to the awarding of scholarships and bursaries. (2) Scholarship programmes of this Measure are announced for an indefinite period. Article 2 In accordance with article 3 of the Regulations of MU, the Dean of the F aculty announces the following scholarship programmes: a) Merit scholarship programme, b) Scholarship programme to support short-period foreign and domestic study stays, c) Scholarship programme to support diploma thesis writing in foreign language, d) Scholarship programme to support student scientific activities, e) Scholarship programme to support student scientific language competence, f) Scholarship programme to support student publishing activities, g) Scholarship programme to support student scientific and research activities, h) Scholarship programme to support student club and other activities, i) Scholarship programme to support internalisation of doctoral degree students, 2 j) Scholarship programme to support short-period study stays of foreign students. NOTE: Sections two and three of this Measure are not included in this version, as they relate exclusively to students of Bachelor and Master study programmes. Section four Scholarship programmes exclusively for Master’s degree study programme students and doctoral degree programme students Article 7 Scholarship programme to support student scientific language competence (1) The purpose of the scholarship programme is to support scientific language competence of students of Master’s degree study programmes and doctoral degree study programmes in other than Czech or Slovak languages (hereinafter referred to as “foreign language”) in the field of law. (2) The purpose of the scholarship is to cover the costs of a fee, or its part, expended by the student for gaining a pass in a certified specialist language examination proving knowledge of foreign legal language. (3) The scholarship is intended solely to reimburse the costs of the professional language examinations referred to in the preceding paragraph. They cannot be awarded in connection with a general language examination, regardless of its level and degree of difficulty. The scholarship also cannot be used to cover the costs of exam preparation (e.g. language courses) or the cost of learning materials. (4) The conditions for awarding the scholarship are successful completion of the professional language examination according to paragraph 2, proof of payment of the examination fee and timely submission of the application according to paragraph 6. (5) The scholarship is, as a rule, awarded in a single sum in the amount of the specialist language examination fee. The maximum amount of the scholarship is CZK 6.000. (6) The scholarship is awarded by the Dean at the request of the student submitted within three months of passing the examination. The time limit may be extended by one month in cases of special consideration. In addition to the information specified in Article 12, Par. (4) of the Regulations of MU, the application contains the designation and a brief description of the language examination and the date and place of successful completion of the examination. The application must be accompanied by proof of successful 3 completion of the examination (e.g. a certificate), proof of payment of the examination fee and an affidavit from the applicant that the examination fee has not been or will not be reimbursed from other public sources. Before deciding on the scholarship, the Dean may request a translation of the examination certificate, more detailed information about the organiser of the examination, the nature and conduct of the examination and the classification awarded. Article 8 Scholarship programme to support student publishing activities (1) The purpose of the scholarship programme is to support the publishing activities of students of Master's degree programmes and doctoral degree programmes of the Faculty in the form of peer-reviewed articles in the categories Jimp, Jsc or Jost, essays in proceedings in the categories Dsc and Dimp, or in the form of books in category B and chapters in books in category C (hereinafter referred to as "publications"). The scholarship is an award for work on a publication and is intended to motivate the student to become more active in publishing. (2) The scholarship may be awarded to a student of a doctoral study programme regardless of the form of study. (3) The publication must meet requirements of the methodology for evaluating research organizations and research, development and innovation purposetied aid programmes issued by the Government of the Czech Republic. (4) Publishing the publication in one of the formats listed in par. 1 of this measure is an obligatory condition for the scholarship award. In exceptional cases, the publication condition is deemed to be fulfilled if the publication is accepted for publication. This fact must be documented by a confirmation of acceptance of the publication for publication by the publisher or editor. Meeting the condition is checked by the chief librarian or an employee authorized by her/him. (5) The publication of a book may be financially supported from the resources of the Faculty. The supported scientific book must be peer-reviewed and published by a renowned publishing house with a scientific editorial board. The Vice-Dean for Science and Research decides on the granting of support on the basis of the student's application. In the case of a doctoral student, the application includes a recommendation from his or her supervisor. The opinion of an academic staff member designated by the focus of the book will be sought for the application of a Master's student. (6) Support under this measure shall not be awarded if the student's publication proposed for award has been awarded other public (e.g. specific research 4 project, excluding projects aimed at monograph publishing, GAČR project, TAČR project etc.), or private sources (excluding royalties). (7) The condition for awarding the scholarship is also the insertion of the publication into the Masaryk University repository. (8) The scholarship is awarded: a) for an article of the Jimp category in the amount of CZK 10,000 to 15,000 depending on the level of expertise and scope; in the case of journals from quartile Q1 or Q2 in the amount of CZK 25,000; b) for an article in the Jsc and Jost category, for journals included in WoS, the Emerging Sources Citation Index (ESCI) Arts and Humanities Citation Index (AHCI), and for other comparable articles in the Jost category, in the amount of 3,000 to CZK 15,000 depending on the level of expertise and scope; c) the amount for a book in category B: CZK 5,000 to 20,000 depending on the level of expertise and scope; in the case of a prestigious foreign publisher, up to CZK 25,000; d) the amount for a chapter in a category C book: a proportion of the amount corresponding to the remuneration for the entire monograph, determined according to the number of pages of the relevant chapter in proportion to the number of pages of the entire monograph. The Dean is entitled to request the opinion of the Commission for the Evaluation of the Faculty's Scientific Achievements to assess the criteria under this paragraph. (9) If more than one student author has contributed to the publication proposed for the award, the scholarship shall be distributed pro rata according to the author's share. (10) The scholarship and its amount shall be awarded by the Dean at the request of the student, submitted by 31 August at the latest for publications published in the first half of the calendar year, and by 31 January of the following year for publications published in the second half of the previous calendar year. In addition to the requirements under Article 12 of the Regulations of MU, the application must include the identification data referred to in paragraph 1, the supervisor's statement on the professional level and scope of the publication; the supervisor's proposal on the amount of the remuneration and its justification; and the supervisor's statement that the parameters referred to in paragraph 3 have been met. The application must also be accompanied, if the publication is not yet published, by a confirmation of acceptance for publication and the published text itself. If the publication is also available electronically, a link to the electronic address is sufficient. Section five 5 Scholarship programmes for students of Mater’s, Bachelor and doctoral degree study programmes Article 9 Scholarship programme to support scientific and research activities (1) The purpose of the scholarship programme is to support the involvement of students of the Faculty in scientific activities in the field of law, in the form of active participation (public presentation with a paper) at scientific conferences and professional seminars (hereinafter referred to as "conferences") and student competitions, e.g. moot court competitions (hereinafter referred to as "moot court events"). (2) The scholarship may be awarded to a student of the Faculty regardless of the study programme or form of study. (3) A condition for the award of a scholarship is active participation in a conference or moot court event related to the programme of study. This is evidenced by the student's acknowledgement of the presentation or acknowledgement of acceptance of the paper in the printed proceedings. (4) The purpose of the scholarship is to cover the costs incurred by the student in connection with participation excluding board and refreshments. The scholarship may be awarded in advance in the extent specified in par. 9 in case of a conference abroad or a moot court type event abroad. (5) The condition for the award of a scholarship to cover the costs associated with participation in moot court events is the inclusion of the relevant moot court in the study plan and the guarantee of the course by an academic staff member of the Faculty. Exception in justified cases is determined by the Dean or the viceDean authorized by him/her. A detailed list of costs is included in the application for inclusion of the course in the study plan. (6) In exceptional cases, the scholarship may be awarded to a student who is not taking an active part in a moot court type event. The student must prepare for the event together with the other students who are taking an active part in it, and they will take an active part in it in the following year (hereinafter referred to as “shadowers”). The decision will take into account in particular the importance of the moot court, the amount of costs reasonably incurred and the number of students participating in the moot court. (7) The scholarship is normally awarded in an amount equivalent to the conference or similar participation fee. Taking into account the professional importance of the conference or moot court event, as well as the nature of the student's active participation, the scholarship may be further increased by an amount corresponding to reasonable accommodation costs and public transport fares. (8) A scholarship to cover the costs of attending the conference may be awarded up to a maximum of CZK 20,000. The scholarship can be awarded in one lump sum or in several instalments. 6 (9) A scholarship may be awarded in advance to cover reasonable costs associated with participation in a foreign conference or moot court event in justified cases, to the extent that it covers part of the student's necessary preliminary costs. A further decision may then award an amount corresponding to the proven and reasonable costs not covered by the previous grant. If the student did not actively participate in the foreign event, the Dean will decide to withdraw the scholarship. (10) If the expected cost of participation in the conference exceeds CZK 10,000, the student must inform the relevant department of this fact at least one month before the conference and submit a breakdown of the expected costs. At the same time, a letter of recommendation from the expert guarantor on the expected benefit of the participation in relation to the total cost should also be submitted. In the case of doctoral students, the supervisor is the professional guarantor; he/she comments on the professional contribution of the participation in relation to the dissertation. In other cases, the professional guarantor may be appointed by the relevant Vice-Dean designated according to the study programme in which the student is enrolled. (11) The scholarship shall be awarded by the Dean upon application by the student within two months of the date of the conference or moot court event. In addition to the data referred to in Art. 12 of the Regulations of MU, the name, place and date of the event, the organisers' details with a link to the organisers' websites, the title of the applicant's contribution (or competition paper or performance), details of the conference or participation fee and other costs (accommodation and travel costs, the amount of the costs must be supported by appropriate documents), the amount of the scholarship requested, an affidavit of active participation in the event unless participation is credibly proven otherwise and, in the case of students in a doctoral programme, a statement from the supervisor. In the case of an application under paragraph 6, it shall include a statement from the guarantor of the course. Article 10 Scholarship programme to support student club and other activities (1) The purpose of the scholarship programme is to support student association activities aimed at developing mutual, especially international, cooperation between student associations and organizations (typically meetings of members of student societies of different universities). The scholarship programme is designed to provide targeted support for student societies and organisations (hereinafter referred to as "societies") that have at least 30 members, whose activities at the Faculty influence the overall events at the Faculty and whose activities contribute to improving the quality of the academic environment. In cases worthy of special consideration, the Dean is authorized to determine an exception to the number of members, taking into account the importance of the association's activities and the nature of the event supported. 7 (2) The scholarship programme also serves to support the development of mutual cooperation between the Academic Senate and academic bodies of other universities. (3) The scholarship can also support the publication of student journals within the MU academic environment and related to the activities of the Faculty, in the form of an award for organisational assistance or authorship of an article published in a given journal. (4) The purpose of the scholarship programme is not to support events such as conferences, summer schools or student competitions. (5) A scholarship within this Scholarship Programme can be awarded to students of Bachelor’s, Master’s or doctoral degree study at the Faculty. (6) The scholarship pursuant to par. 1 and 2 may be awarded to a student who is a member of the relevant association or academic senate and who has participated in an event that meets the specified criteria. (7) The scholarship pursuant to par. 3 is awarded in recognition of the student's extraordinary initiative, which is directly related to organizational activities in the publication of the respective journal or authorship of an article published therein. (8) The scholarship pursuant to par. 1 and 2 shall normally be awarded in an amount equivalent to the participation fee and the reasonable costs of accommodation and travel by public transport. A particular student association or the Academic Senate is entitled to obtain up to CZK 100,000 in a given academic year, prorated by semester. In exceptional cases, the Dean may increase this amount, taking into account the nature of the events supported and the importance of the student association's activities. The scholarship may be awarded in one lump sum or in several instalments. (9) The scholarship pursuant to par. 1 and 2 is awarded by the Dean on the basis of a student's application. In addition to the information required by Article 12 of the Regulations of MU, the application must include the name, location and date of the event, the organisers' details with a link to the organisers' websites (if applicable), details of the participation or similar fee and other costs (accommodation and travel costs), the amount of the scholarship requested, a declaration of honour of the participation in the event (or certificate of participation, if applicable), the recommendation of the President of the association or the Academic Senate to award the scholarship, indicating the importance of the event for the activities of the association or the Academic Senate. The application shall be accompanied by documents proving the amount of the costs and their composition. (10) The scholarship pursuant to par. 3 is awarded by the Dean on the basis of a proposal from the editor of the journal concerned. This proposal shall include the student's name and surname, the student's university ID number (UCO), the name of the journal, the proposed amount of the scholarship, a description of the student's activities, and a justification of the amount of the scholarship. The Dean is not bound by the proposal for the amount of the scholarship. Section six 8 Scholarship programmes exclusively for students of doctoral study programmes Article 11 Scholarship programme to support internationalisation for students of doctoral study programmes (1) The purpose of the internationalisation scholarship programme is to support the participation of doctoral students in: a) internships and study stays at foreign universities, scientific research and other international (European) institutions (hereinafter referred to as "foreign stay"), b) foreign study stays implemented through the Erasmus+ programme for students of doctoral study programmes, c) summer schools, professional seminars, courses and trainings organised by foreign universities or other foreign professional institutions (hereinafter referred to as "foreign professional courses"), d) summer schools, professional seminars, courses and training organised in a foreign language with the exclusive or predominant participation of foreign experts (hereinafter referred to as "professional courses in a foreign language"). (2) A condition for the award of a scholarship pursuant to paragraph 1, letter a) is the preparation of a project for a foreign stay in which professional issues related to the research focus of the student's dissertation will be addressed. The student will attach to the project a recommendation opinion of the supervisor with a statement on the expected benefit of the foreign stay for the solution of the project. It will also include a statement from the selected foreign institution providing expert guidance on the project. The preliminary application for the scholarship, supplemented by the above-mentioned scholarship documents, must be submitted to the Dean of the Faculty no later than 14 days before the start of the study abroad. The scholarship pursuant to in paragraph 1, letter a) is intended primarily to support stays of at least one month, with a minimum stay of at least 14 consecutive days. The scholarship is intended to cover the costs of travel and reasonable accommodation, as well as other costs associated with the implementation of the project. Scholarships cannot be awarded for stays abroad for the purpose of postgraduate education such as LLM, etc. As a rule, the scholarship is awarded in the amount of the costs incurred to cover the cost of travel by public transport and the cost of reasonable accommodation; the scholarship may also be increased by the costs reasonably incurred in connection with the implementation of the study abroad project. The maximum amount of the scholarship is CZK 50,000. (3) The scholarship pursuant to paragraph 1, letter (b) may be awarded to a student who is participating in a foreign study stay through the Erasmus+ programme. A condition for the award of the scholarship is the submission of proof of enrolment in the programme. The scholarship may be awarded as a contribution towards the costs of travel and reasonable accommodation which the student 9 cannot meet from the funds provided under the programme. The scholarship is normally awarded as a contribution to cover the reasonable costs of travel on public transport, reasonable accommodation, or other costs incurred by the student that cannot be covered by Erasmus+ funding. The maximum amount of the scholarship is CZK 40,000 per calendar year. (4) The scholarship pursuant to paragraph 1, letters c) and d) may be awarded on condition that the foreign professional course (course in a foreign language) falls within the framework of the programme studied and participation in it is recommended in advance in the supervisor's opinion on its professional quality and benefit for the particular student in relation to the research focus of his/her dissertation. (5) The scholarship is normally awarded in the amount of the reasonable costs of tuition fees, reasonable accommodation and travel by public transport. The maximum amount of the scholarship is CZK 20,000 per calendar year in the case of professional courses abroad and CZK 10,000 per calendar year in the case of professional courses in a foreign language. (6) The scholarship can be awarded in one lump sum or in instalments. (7) The scholarship (part of it) may be awarded to cover the reasonable costs of the foreign stay or course pursuant to paragraph 1 even before the foreign stay begins, to the extent of the necessary costs incurred by the student. In a subsequent decision, a scholarship may be awarded in an amount corresponding to the costs incurred and proven not covered by the previous scholarship. (8) The scholarship is awarded by the Dean based on the doctoral study programme student’s application submitted no later than two months after the termination of the foreign study stay or course pursuant to paragraph 1. In addition to the information specified in Article 12 of the Regulations of MU, the application also includes the location, designation of the destination or organizing (foreign) institution, duration of the stay (course), information on the costs incurred, the amount of the requested scholarship, confirmation of completion of the stay (course), a description of the benefits achieved and the results of the stay (course), and the supervisor's professional opinion on the benefits achieved and the results of the stay (course) after discussing them with the student. The Dean may not grant the scholarship at all or in the required amount if the description of the contribution and results achieved or the statement of the supervisor shows that the purpose of the stay (course) was not fulfilled. Section seven Scholarship programmes for foreign students Article 12 Scholarship programme to support short-term study stays of foreign students 10 (1) The purpose of the scholarship programme is to support short-term study stays of foreign students enrolled in Master's degree programmes, based on a bilateral agreement between the Faculty and the University of Illinois Chicago School of Law, concluded on 1 March 2006. (2) The condition for awarding the scholarship is the enrolment of the foreign student for study, approval of the study plan and fulfilment of the study obligations arising from it. Violation of these obligations or the commission of a disciplinary offense is grounds for withdrawal of the scholarship. (3) The amount of the scholarship is CZK 8,000 per calendar month and is always awarded for the relevant semester. The scholarship may also be awarded to cover the reasonable costs of accommodation for the duration of the study stay, usually in the amount customary for MU accommodation facilities (Administration of Residence Halls and Canteens). (4) The scholarship is paid in monthly instalments on Masaryk University's paydays. Section eight Common, temporary and concluding provisions Article 13 (1) Scholarships are awarded in pursuant to the Regulations of MU. (2) The source of funding for scholarships under announced scholarship programmes is the Faculty's scholarship fund or other currently designated funds. (3) I hereby authorize the Vice-Dean for Master degree programme with compliance with this measure, its implementation, interpretation and possible amendments in case of in the case of Bachelor and Master students, and the Vice-Dean for Doctoral Studies and Rigorous Proceedings in the case of doctoral students, unless otherwise stipulated in this measure. (4) This Measure repeals the following Measures and Directives on the date of entry into force: Dean's Directive No. 7/2011 Merit Scholarship Programme for Master's Studies, Dean's Directive No. 2/2012 Scholarship Programme to Support Full-time Study in the Doctoral Programme of Theoretical Legal Sciences, Dean's Directive No. 11/2013 Scholarship programme for acquiring skills and knowledge of working with electronic information resources, Dean's Directive No. 3/2014 Scholarship Programme to support short-term study stays of foreign students, Dean's Directive No. 1/2015 Scholarship Programme to Support Project Activities, as of the effective date of this measure, 11 Dean's Directive No. 11/2017 Scholarship programme for the preparation of a grant project, Dean's Measure No. 9/2018 Scholarship programme for the support of students' auxiliary scientific activities, Dean's Measure No. 10/2018 Scholarship programme to support students' professional language competence, Dean's Measure No. 11/2018 Scholarship programme to support short-term foreign and domestic study stays of students, Dean's Measure No. 1/2019 Study Programme to Support Foreign Study Stays, Dean's Measure No. 8/2019 Scholarship programme to support student clubs and other activities, Dean's Measure No. 9/2019 Scholarship programme to support student publications, Dean's Measure No. 1/2020 Scholarship program to support students' scientific and research activities. (5) The procedure for applications and proposals submitted before the entry into force of this measure shall be completed in accordance with the existing measures or guidelines governing the relevant scholarship programme.
