Relationship between transitional justice and democratization – Prosecution or Peace? The place of amnesties in TJ setting – TJ and truth seeking as a prerequisite of democracy and the rule of law?

Position paper assignment

Select one of the following topics and write a position paper of max. 2000 words.

If you want, you can work in groups.

·             Can we have a successful democratization without addressing the crimes of the past? Or to the contrary, can a lack of transitional justice contribute to democratic backsliding?

·             What role do transitional justice issues play in current democratic backsliding/democratic decay in EU member states?

·             Are domestic or international courts better suited to deal with transitional justice?
