1 UCP 600 FAQ FOR ICC UK MEMBERS AND CUSTOMERS Three years in the drafting, the release of the new UCP 600 will mean changes for all those involved in trading internationally. Exporters, importers, bankers, lawyers and transport professionals will need to refer to the new and changed provisions of the UCP 600 that are designed to facilitate the financing and movement of goods across borders. UCP 600 will include a new section of "definitions", containing terms such as "honour" and "negotiation"; a replacement of the term "reasonable time" with a definite number of days for examining and determining compliance of documents; an expanded description of "original documents"; changed practice for notice of refusal; and re-drafted transport articles. The final draft text of the UCP 600 will be submitted to the Banking Commission members at their meeting of 24/25 October 2006 for approval. ICC and ICC UK is putting in place plans to ensure that on approval UCP 600 is available to the market as swiftly as possible. If approved the UCP 600 will immediately go to print and will be available for dispatch soon after. UCP 600 is scheduled to come into force from 1 July 2007 and banks, traders and trade services professionals will be able to use the interim period to become familiar with the new Articles. Orders for UCP can be made now at reduced prices (see below), valid until 15 December 2006. The imprinting of logos onto bulk orders is also available (see below). WHEN WILL UCP 600 BE AVAILABLE? If approved by the Banking Commission, the UCP 600 will be despatched from ICC United Kingdom as soon as it becomes available in November/December. Publications will be despatched in order of receipt of payment. IN WHAT FORMS WILL UCP 600 BE AVAILABLE? In hard copy, UCP 600 will be available in two formats: a booklet and a leaflet. Booklet ­ ICC Publication No. 600 The publication will be approximately 60 pages and the dimension of ISBP (13cm x 23cm). These can be ordered as individual books. Leaflet ­ ICC Publication No. 600LF This will be in the form of an A4 size 8-page fold-out (21cm x 27 cm). These will be sold in packs of 25. HOW MUCH WILL UCP 600 COST? Until 15 December, ICC UK will offer an introductory price. This price will rise from 1 January 2007. Please note that as our offices will be closed for the Christmas break and due to our inventory audit, no orders will be processed between 19 December 2006 and 3 January 2007. Yes. It is possible to order logo personalisation on your copies of UCP. Imprinting offers banks and service providers an excellent opportunity for marketing to key clients by offering copies as gifts or providing in-house copies to staff. WILL THERE BE A "UCP 500 AND UCP 600 COMPARED" / "GUIDE TO UCP 600"? ICC will publish a Commentary to the UCP 600, authored by the Drafting Group of the UCP 600. This is expected to be finalised in March-April 2007 and available soon thereafter. The Commentary will not be an Official Banking Commission approved document, and will be treated as educational rather than official. IN WHAT LANGUAGES WILL UCP 600 AND THE COMMENTARY BE AVAILABLE? ICC National Committees will be responsible for reproducing the UCP 600 in their national language. At this stage, the UCP 600 is expected to be available in English, French, German, Spanish, and Arabic. Orders for language copies can be made by ICC UK on your behalf, or directly with the relevant National Committee. CAN I REPRODUCE UCP 600 IN OUR OWN HARD COPY PUBLICATIONS (COPYRIGHT)? ICC will take requests for reproduction of the UCP 600. ICC UK can assist in the process and should be your first point of contact. The reproduction of ICC publications in any format - graphic, electronic or technical, including photocopying, scanning, recoding, taping, or information retrieval systems - in its entirety or in part is strictly prohibited unless permission has been granted, in writing, by ICC Services/Publications Department. A reprint fee is normally charged and copyright acknowledgement must be used and an agreement confirmed in writing and countersigned by the copyright user and the copyright holder. There are specific conditions attached to the reproduction of the UCP 600 and interested parties can contact ICC UK for further information. Please note that 3 existing permission to re-print/reproduce UCP 500 does not carry over to the UCP 600, and interested parties should re-apply for permission with regards to UCP 600. Please also note that the Commentary to the UCP 600 cannot be reproduced. This is applicable to all Guides and copublications. ICC operates a fair use provision for reproduction below 20% of the text and may also grant special conditions for reproductions in academic publications or small print runs and the like. Any form of electronic data storage and/or retrieval, commercial and/or non-commercial software products, delivered in stand-alone form - such as CD-ROM - and/or on any kind of electronic networks, including the Internet and private intranets is considered electronic or online media. For intranet/electronic/online media, terms and fees are considered on a case-by-case basis, and copyright acknowledgement must be used accordingly. Reproduction of part of a set of ICC Rules may be authorised by ICC Services/Publications Department, on a non-royalty basis, if such reproduction does not exceed 20% of the text. We will endeavour to have a 3 day turnaround of despatch from receipt of payment. WAYS TO PAY FOR YOUR ORDER To make a pre-publication order and take advantage of the pre-2007 discount, please complete the order form attached and return it prior to 15 December 2006 with your payment. If you wish to take advantage of logo over-printing please contact us directly. You will be asked to provide ICC UK with your logo in a specific format no later than 15 December 2006 or we will not be able to guarantee logo- overprinting. Please note that orders must be paid in advance. Orders will not be processed without receipt of payment. Payment can be made by debit/credit card (Visa, Mastercard, Switch), by BACS and by cheque. Please ensure that the reference and remittance is provided with all forms of payment. All bank charges must be paid by the remitter. If charges are paid by ICC UK an invoice will be re-issued for the bank charges. These FAQ form part of the terms and conditions of ordering and payment for UCP 600 and are subject to the approval by the Banking Commission of the draft at its October meeting. In the event that there is some delay (more than 60 days) to the approval and the printing of the UCP 600, ICC UK will assume that your order will remain valid for subsequent approval unless you stipulate otherwise in writing to us. In the event that the UCP 600 is not approved, ICC UK will refund in full all payments made within 30 days. 4 VAT: Books are zero-rated for VAT purposes, however logo imprinting and copyright requests will incur VAT.
