Seminar Group 16 Miniconference – Day 2 We have the honor to welcome you to the second Miniconference day of seminar group 16. Today is very special day for all of us, because three fabulous groups of presenters had accepted our invitations. No name resonate as theirs among lawyers. At first prof. Sýroka, prof. Olič and prof. Filip are going to take us into a dramatic world of direct presindetal election theory and practice. They will present how profesionals perceive the last presidental election in the Czech republic. The second presentation is going to be held by prof. Šimo, prof. Malota, prof. Volková. They are the best known specialists on race discrimination and they will explain to us this worldwide phenomenon. The third presentation is aimed at current questions which trouble us every night. Prof. Baťa, prof. Tesner and prof. Jonas will analyze the New Civil Code and its relation to other divisions of law and answer all of them. Sýroka, prof. Olič, prof. Filip, csc. Czech presidential election, 2013 The theme of this presentation is focused on Czech presidential election which was held on January 2013. The presentation is divided into three main parts. The first one deals with the theoretical definitions of the topic such as direct or indirect election, the position of president in the state executive , conditions of candidacy etc. The next chapter describes the course of previous presidential election as well as introduces each official candidates for the office. The last chapter tries to answer the question which position of directly elected president should be optimal in order to consolidate czech political stability. The aim of this work is to analyze the current presidential electoral system and to evaluate pros and cons of direct presidential election. Race discrimination - prof. Šimo, prof. Malota, prof. Volková We´ve chosen racism as a target of our presentation because it´s timeless and worldwide phenomenon which influenced entire history of civilized humanity and thus, of course, developement of law and historical events marked by racism changed and still changing legislation in relevant area. Our presentation has no ambitions to explain racism and it´s consequences unilaterally as is customary in related documents with similar topic, we try to analyze this problem as phenomenon of all cultures and races, not only in traditional way in which is common to claim that racism equals white genocide against the whole world. In our task, we want to explain the term of race discrimination itself, then say something about types of race discrimination, outline some possible ways of elimination of discrimination, which brings us to other topic in which we want to talk about declarations and international law against racial discrimination, some view back in time is always important, so we include some historical context, and in final section we want to deal with modern conception of term of racism and it´s influence to modern law. New civil code and its relation to other divisions of law - prof. Baťa, prof. Tesner, prof. Jonas In begining of year 2014 in Czech republic New Civil code is about to be active and it will replace existing Civil code from 1964. This brings many problems connected to existing Civil law and as well to other divisions of law, which are connected to Civil law. We will focus on connection of New civil code to Family law, Commercial law, Employment law and Criminal law. And changes, which New civil code will bring to these parts of law. Also we will be concentrated on differences between New civil code and old Civil code. These results will help us understand the problematic of loading New civil code in Czech legal system and to be aware of new connections and expressions.
