Legal Research Methodology I

Topic 1: How to do a good research in law (lecture, 21 March 2023, 4PM)

I am not sure which room will be available, but let's meet in front of room 043 (ground floor, right from the main entrance)


The first session will try to provide you with basic background on what is important to author a good research text in legal science.

In general, we will focus on the following points that you need to consider when writing a paper:

  • what? (topic)
  • why? (meaning and aim)
  • to whom? (target group)
  • how? (approach, methods)
  • how? in the narrow sense (formal criteria)

Obligatory written assignment (please do it after the lecture, deadline is set to March 31)

I would like to know more about your PhD projects. It does not matter on what stage of development you are or if you are not proficient with the required issues (e.g. empirical methods), I just wish to explore and understand your thinking about the matters so that I can use the correct examples in the course. Obviously, you shall use the knowledge gained during the first lecture.

Please try to fill out to the following parts/questions: 

Planned title of the thesis

Supervisor and department

Aim of the thesis: What research problem do you seek to solve? (150 words) 

Research question: It is a summary of the previous point that shall briefly and clearly define what the thesis seeks to answer 

Does your thesis have any normative dimension?: See the lecture, are you going to pursue any extralegal approach/value?

Does your thesis have any empirical dimension?: See the lecture, are you going to apply any empirical methods? Explain the positive or negative answer, if you reply yes, then what is your approach and try to formulate relevant hypotheses.

Will your thesis be purely doctrinal?: If the answer to the previous two questions is negative, explain, how and why doctrinal approach allows to answer your research goal.

How will your thesis be useful?: Explain how the results of your thesis might be beneficial for theory or practice. Why shall be anybody interested in it? What readers are going to be your target group?
