Kantorowicz, Llewellyn, Gény and Ehrlich can be
classified as authors (among others) engaged in the field of methodology of
legal science. Although their work is located at the end of the 19th
century and beginning of the 20th century, they deepen knowledge
about legal science. Weber is a distinguished author engaged in the area of the
methodology of legal science. The question is if the legal science is a social
science – and the answers are contradictory.
The assignment is to read the literature mentioned
above and try to ascertain the specific character of legal science. Then
compare your findings to approach held by Max Weber. Try to find differences
and correspondences (if there are any). Try to conceptualize the paradigm of
legal science in the context of social sciences.
- What criteria are relevant to research methodology, especially in legal science?
- Does legal science meet the requirements of social science?
- Does legal research (as a part of legal science) meet requirements of research?
- Has legal science a comprehensive methodological compendium suitable for legal research?
- Can legal science contribute to any social research (on a general level)?
You will present your findings and answers on the seminar
(no written output is expected; the seminar can be managed as an individual or joint
meeting). The time (January/February) will be adjusted to your other duties at
Brno (We will discuss time via e-mail; it is possible to present your findings
and to answer asked questions by Microsoft Teams).
