Homework to be done before the lecture:

1) Choose a topic for a 5-10 minutes presentation (to be presented by you during lecture 5 - on 22 November 2022) topic: "Impact of the Case Law of the European Court of Human Rights on Family Law in Europe". You should choose one ECtHR case (ideally from your national jurisdiction) and present: the basic facts of the case, the Court's conclusions and argumentation and mainly how the judgement changed national practise or legislation subsequently.  Ideally, the case should implore aspects of parentage and parental responsibility. Otherwise, the teacher must agree.

Let others know about your choice together with brief (2-4 sentences) annotation until 28 October 2022 via discussion thread:

2) Read the judgements and documents listed below in "Reading" and "Caselaw" and be prepared to discuss case facts and the argumentation of all parties.

3) Write an application to ECtHR based on the facts that we have been dealing with last lecture . You should write one application per group. The application should be submitted to the homework folder 48 hours before our lecture. 

 

Caselaw:
