Course objectives
The instruction in this course introduces students to basic terms relating to the EC and EU, as well as the role of these units as fundamentals of the European integration. After a development survey ranging from the beginning of the 1950s up to the present the course deals with the supranational concept and the organisational structure of the EC/EU as well as the competences toward the member states. Furthermore, basic information concerning EC and EU law from the systemic perspective is included. As far as the content is concerned, attention is paid to the four basic freedoms of the EC internal market.
The goal of the course is to make students familiar with the mechanism of EC/EU functioning as the supranational organisation, namely from the perspective of institutions and law. Students will thus acquire knowledge of the EC/EU position with respect to the member states, as well as in institutions functioning and they will understand the regulative function of EC law. Contentwise, they will get familar with only the basic rules of the EC single internal market (the remaining rules are included in the follow-up course).

  • 4. Organisational structure of EC/EU (Commission, Council).
  • 5. Organisational structure of EC/EU (European parliament, Court of Justice).
  • 6. EC law concept and characteristics, primary and secondary sources.
  • 7. Relation of EC law and national law (direct effect, priority).
  • 8. Legislative procedures in EC. EC-law exaction.
  • 9. Common market, single internal market, economic and monetary union, basic freedoms.
  • 10. Free movement of goods.
  • 11. Free movement of people.
  • 12. Free movement of services and capital.
  • 13. Topical questions of Czech membership in EU (legal problems).

  • 4. Individual bodies of EC/EU 102/81 Nordsee 283/81 C.I.L.F.I.T
  • 5. EC law application and interpretation, judicature of ECJ C 6 and 9/90 Francovich C 46/93 and C 48/93 Brasserie du Pê cheur a Factortame. Mid-term test.
  • 6. Free movement of goods, free movement of people 120/78 Cassis de Dijon 41/74 Van Duyn
  • 7. Alternate date for a check test. Lectures and seminars are taught in accordance with the given topics as far as the content is concerned. The mid-term test in 9th and 10th week of instruction is compulsory (see conditions for passing the course).

Lectures, practical examples, discussion on solved cases, argumentation.
The course is finished by written exam.The presumption of successful graduation of final exam is the assigned attendance at seminars. Next condition is that student must successfully pass control test.

Výuka v tomto předmětu seznamuje se základními pojmy týkajícími se ES a EU a s postavením těchto celků jakožto základu evropské integrace. Po přehledu vývoje od počátku 50. let do současnosti je pojednáno o nadstátním pojetí a organizační struktuře ES/EU a o pravomocech vůči členským státům. Dále jsou podány základní informace o právu ES a EU z hlediska systémového. Z hlediska obsahového je věnována pozornost čtyřem základním svobodám vnitřního trhu ES.

Vztah práva ES a vnitrostátního práva (přímý účinek, přednost). 8. Legislativní procedury v ES. Vynucováni práva ES. 9. Společný trh, jednotný vnitřní trh, hospodářská a měnová unie, základní svobody. 10.Volný pohyb zboží. 11.Volný pohyb osob. 12.Volný pohyb služeb a kapitálu. 13.Aktuální otázky členství ČR v EU (právní problémy).

Kurz Evropské právo pro ekonomy poskytuje základní přehled o Evropských společenstvích (Evropské unii) z hlediska jejich institucionální výstavby a práva jako nástroje regulace jejich činnosti. Zahrnuje čtyři okruhy problémů: 1. institucionální právo (vznik, struktura, nadstátní charakter ES a EU), 2. právo Společenství jako autonomní právní řád, vztah k mezinárodnímu právu a zejména k vnitrostátnímu právu členských zemí, 3. právní úprava vnitřního trhu a jednotlivých politik Společenství, 4. právní otázky přidružení a budoucího členství ČR. Forma zkoušky: písemná a ústní.

Kurz Evropské právo pro ekonomy poskytuje základní přehled o Evropských společenstvích (Evropské unii) z hlediska jejich institucionální výstavby a práva jako nástroje regulace jejich činnosti. Zahrnuje čtyři okruhy problémů: 1. institucionální právo (vznik, struktura, nadstátní charakter ES a EU), 2. právo Společenství jako autonomní právní řád, vztah k mezinárodnímu právu a zejména k vnitrostátnímu právu členských zemí, 3. právní úprava vnitřního trhu a jednotlivých politik Společenství, 4. právní otázky přidružení a budoucího členství ČR. Forma zkoušky: písemná a ústní.

Course objectives
European Law for Economists I, II (PPEPEI, PPEPII) The course European Law for Economists gives the basic overview of the European Communities (European Union) from the point of view of their institutional structure and law as an instrument for regulation of their activity. It includes four problem areas: 1. institutional law (establishment, structure, supranational character of the EC and EU), 2. the Communities law as an autonomous legislation, relationship to the international law and particularly to internal laws of member countries), 3. legal regulations of the common market and the individual policies of the Community, 4. legal questions of the Czech Republic s association and future membership. Credit requirements: active participation in seminars, seminar essay. Examination: written and oral.
