- Course objectives
- The goal of eduacation of insolvency law is to make the students the acquaintance of the fundamentals and institutes of the insolvency substantive law and insolvency procedure. At the end of this course the student will be able to: - understand the fundamentals and institutes of insolvency law, - use the information about the fundamentals and institutes of insolvency law to solve particular situations, - create independently some procedural acts (e.g. registration of claim) in ordered subject, - propose consequential ways how to solve bankruptcy situations, - apply provisions of insolvency law in particular situations, - interpret insolvency law in accordance with the invariable judicial practise of the courts
- Syllabus
- 1) scope of application of insolvency law, bankruptcy, principles of insolvency procedure, exceptions from the scope of insolvency law, decision makers, insolvency administrator, creditor s authorities, insolvency register 2) insolvency procedure, incidence disputes 3) satiation of claims after bankrupt 4) assets, nullity and futility of legal acts according to insolvency law 5) methods of setting the bankruptcy, audition, imperceptible audition, methods of setting the bankruptcy of finance institutions 6) reorganization, discharge from debts
