Course objectives
The aim of the course is to: - introduce students to methods of dispute resolution - introduce students to international arbitration - teach them to formulate an arbitration agreement - introduce them to the arbitration proceedings - introduce them to the auxiliary and control functions of courts - introduce them to the recognition and enforcement of foreign arbitral awards
Learning outcomes
After completing the course, the student will be able to: - identify methods of resolving disputes between international traders - write different types of arbitration agreements - compare alternative methods of dispute resolution and arbitration - propose a basic procedure in arbitration.

  • Dispute Resolutions - in general, ADR, Mediation, differences International arbitration - definitions, doctrinal approaches, sources, principles International arbitration agreement - types, connection to the main agreement, formal and material conditions, effects, termination, procedure, practical examples Arbitrators, arbitral panels - prerequisites, provisions, exclusion, obligations, authority The applicable law in proceedings before international arbitrators - procedural rules, the applicable law for the merits of the dispute, the scope of public law, EU law Arbitration award and resolution - when, how, defense The relationship between arbitration courts and general courts - auxiliary and control functions, recognition and enforcement of a foreign arbitral award, the New York Convention

Teaching methods
The teaching will be carried out: 1) Frontal teaching method with the personal participation of the student in the faculty building, when an initial mandatory consultation will take place, including the definition of the issue and systematics, key terms and institutes, and the assignment of the completion of the subject. 2) In a synchronous form through three ongoing mandatory group consultations implemented in the MS Teams environment, methods will be implemented: group and cooperative teaching, critical thinking, solving problems from practice, and brainstorming, the emphasis will be on providing feedback, not frontal teaching 3) In an asynchronous form (individual controlled self-study) of the supplied documents in the IS information system and/or textbooks (study texts, video, podcasts, presentations with audio track and other interactive materials)
Assessment methods
The evaluation will be done continuously according to the entry in the electronic curriculum in IS MUNI processed individually by the student. It is evaluated by the teacher for each phase, and the student receives both feedback on his performance and an idea of the evaluation at the end of the semester.
