Course objectives
The purpose of the course is to give a complete and general overview of the Spanish inheritance system. The aim is to bring students closer to the principles that govern succession in Spain, the limits that the deceased has when deciding the destination of his assets, and the types of wills that can be granted and from what age you can make a will in Spain.
In short, to know how the succession phenomenon is regulated in Spain is to know how it is carried out in France, Italy, Portugal and in most of the countries that have taken as a model the French Civil Code of 1804, which has been the source of many European countries.
Learning outcomes
At the end of the course, students should be able to: s a result of taking this course, you should be able to:
- Know the principles of Spanish inheritance law
- Know the criteria to distinguish between heirs and legatees
- Identify the different types of succession
- Identify the different types of wills and the content of the will
- Know the basic rules of intestate succession.

  • 1. Spanish Civil Code: Introduction. The principles of Spanish Inheritance Law. Types of succession and successors: the heir and the legate
  • 2. Intestate inheritance (1): General rules
  • 3. Intestate inheritance (2): Specific rule and exceptions
  • 4. Testamentary succession (1): The last will and testament. Types of wills
  • 5. Testamentary succession (2): The content of the will.

Teaching methods
Lectures and discussions. Powerpoint and keyword list will be used as support.
Assessment methods
Attendance and participation; written assignment: the students will write an essay of approximately one-page in the final class session offering their personal view to whichever materials or topics covered in class that they find most important or the ones that stood out the most to them.
