Course objectives
This subject whose prerequisite is European Law For Economists I introduces students to individual branches of European law. These include economic competition protection, subsidy law, regulation of EUs outward economic relations, consumer protection, labour law, tax law, trading company law, and legal regulation of the freedom area (private law, criminal law, human rights protection and so on). An interpretation of individual rules of law is supplemented with an analysis of the European Court of Justice practice. The aim of the subject is to make students familiar with fundamental legal rules of the European law in individual fields. Students are provided with an explanation of legal regulation method and an outline of contents of basic rules which regulate the individual branches of the European law, in particular those that are economy-oriented. This ensures a basic orientation in EUs legal regulations, valid in the Czech Republic, which students will come across in practice with.
Syllabus
  • 1.Economic competition – in general, the Commission s competences, cartel law 2.Economic competition – dominating position misusing, mergers, unfair competition 3.State assistance regulation 4.Public commissions, trading company law 5.Tax policy, tax harmonisation in the EU 6.Outward trade relations – in general, GATT/WTO law and EC law 7.Outward trade relations – customs union, import and export regulation 8.Outward trade relations – intellectual property protection (TRIPS agreement) 9.Consumer protection 10.Labour law and social security 11.The area of freedom, security and law – trade relations within the EU, human rights protection 12. III. EUs pillar – justice and interior (criminal law), visa and asylum policy 13. II. EUs pillar, topical EU s law development with respect to the membership of the Czech Republic in the EU Lectures and seminars are thematically based on the above mentioned topics. The check mid-test in the 9th and 10th instruction week is compulsory (see conditions for passing the course). Seminars are divided into 6 thematic blocks. Thematic schedule and content orientation of seminars (according to instruction weeks): 1.Introductory seminar 2.European competition law – cartel agreements, dominating position misuse 3.European competition law – company mergers, public assistance, tax discrimination 4.European private law, European trading companies, consumer protection 5.EUs outward relations, check test 6.Schengen agreement, EUs inward security 7.Spare test
