Prerequisites
Students entering the course are recommended to have basic knowledge of legal theory, business law and European law.
Course Enrolment Limitations
The course is offered to students of any study field.
Course objectives
The course aims at providing students with knowledge of selected legal institutions in the field of international trade law. Students should acquire at least basic skills in the field of contracting connected with the field of international trade. The course consists of three blocks corresponding to three levels of relations in the field of international trade: selected chapters from international economic law, selected chapters from the field of international trade management, namely outward trade relations within the EC and the Czech Republic, and problems of legal regulation of international business transactions.

At the end of the course students will:
a) have basic information on the area of legal regulation of relations exercised in the area of international trade;
b) have detailed knowledge of certain international economic law institutes, in particular from the field of WTO law;
c) have basic knowledge of the field of legal regulation of relations in the field of external business relations of the EC and the Czech Republic;
d) have acquired knowledge from the field of legal regulation of international business transactions;
e) have acquired certain contracting skills in this area.
Syllabus
  • 1.Three levels which capture relations in the field of international trade. Legal regulation of the individual relation levels. Sources of law. Characteristics of the individual disciplines.
  • 2.Selected international economic law institutions. WTO law.
  • 3.WTO law. Other selected problems – investment regulation on the international level, problems of double taxation.
  • 4.Outward business connections of the EC. Characteristics of individual business policy tools.
  • 5.Autonomous tools of business policy. Contracting tools of business policy.
  • 6.Legal mode of international business transactions. So-called lex mercatoria speciality.
  • 7.International purchase – sale, part I.
  • 8.International purchase – sale, part II.
  • 9.Legal aspects of transactions providing access to a foreign market – Distributor contract, franchising, commercial representation, joint ventures.
  • 10.Legal aspects of transactions in the field of international cargo traffic.
  • 11.International barter trades and legal regulation of individual transaction types.
  • 12.International investments. Legal aspects of capital equipment supplies.
  • 13.International financial transactions. Settlements of disputes between international traders.

Presentations and task-based learning.

The course finishes with a test (multiple-choice test) and a written exam (problem solving).
