- The course is offered to students of any study field.
- Course objectives
- The course organisation aims at conveying knowledge of basic basic principles of administrative punishment. In the first part of the course students get familiar with basic concepts and institutions whose knowledge is necessary to understand the area of a positive legal regulation. The second part focuses on individual facts of administrative torts, including a given decision process. Attention will be paid to specifics of individual types of administrative torts, particularly to their areas which students will need later in practice. The subject aims not only at making students familiar with the theoretical background of administrative punishment, but it also teaches them to work with a text of a given legal enactment and apply it subsequently to an appropriate issue of fact.
At the end of the course students will:
- understand chosen facts of administrative torts;
- understand mechanisms of imposing penalties and proceedings course;
- have acquired basic knowledge of application practice, especially in business area. - Syllabus
- One topic per week:
- 1.Administrative criminal law – concept, characteristics, division, position within the administrative law system, relation to other branches of law and other branches of science.
- 2.Administrative-legal liability – concept, conditions, features, division, differences from other liability types
- 3.Administrative-legal liability for administrative torts – concept, features, types, differences from criminal acts
- 4.Administrative-legal liability for offences – concept, legal features, legal regulation, object, objective aspect, subject, subjective aspect
- 5.Sanctions – types and principles of imposing sanctions, differences from punishments
- 6.Offences according to Administrative Infractions Act.
- 7.Offences in selected public administration sections
- 8.Offence proceedings according to Administrative Infractions Act– legal regulation, proceedings subjects, course, summary proceedings, enforcement of judgment.
- 9.Administrative-law liability for other administrative torts – concept, legal regulation, features, division, sanctions, differences from offences
- 10.Administrative-law liability for breaches of discipline – concept, legal regulation, types.
- 11.Administrative-law liability for petty offence – concept, legal regulation, types.
- 12.Administrative-law liability for other administrative torts of individuals – concept, legal regulation, types.
- 13.Administrative-law liability for administrative torts of corporate bodies and individuals (entrepreneurs), concept, legal regulation, types and change trends in the field of administrative punishment

- written multiple choise test during semester (20 questions with maximum of 60 marks and mininum 45 marks).
"Any copying, recording or leaking tests, use of unauthorized tools, aids and communication devices, or other disruptions of objectivity of exams (credit tests) will be considered non-compliance with the conditions for course completion as well as a severe violation of the study rules. Consequently, the teacher will finish the exam (credit test) by awarding grade "F" in the Information System, and the Dean will initiate disciplinary proceedings that may result in study termination." - Language of instruction
