- Course objectives
- This subject provides a deep insight into the principles of trade contracts as a result of compromising not only between the contractual parties, but also between them on the one hand and the state-protected interests on the other. It clarifies theoretically the contractual freedom, including the reasons and methods of its limitation by the state (confrontation of the perfect contract and the contract acceptable in practice). The subject matter does not cover only theory, it presents the methodology of the right drawing of contracts (including practical exercise using practical examples), especially with regard to prevention of the conflict between the content of the contract and antimonopoly regulations. The subject provides a survey of individual competition theories and problems connected with their practical implementation. Student are also taught some practical skills for preventing anti-competition procedures (be it unfair competition or the procedures threatening the existence of competitive environment). Students are acquainted with a number of rulings passed by The Office for the Protection of Economic Competition, which results in the awareness of the practical forms of implementing the competition policy and antimonopoly law. An important consideration will also be the issues of competition law internationalization, as a part of economic globalization and the main trends of competition law in the European Union. Examination: oral.
