Course objectives
The case law of the European Court of Justice represents an essential interpretative source of private international law in the EU Member States. It serves both for the unification of the interpretation of EU acts of private international law and for the qualifications. In relation with qualifications it substitutes for the non-existent substantive EU law on private relations, which would otherwise logically follow existing legislation in the area of ​​private international law. The aim of the course is to analyze the main case law of the CJEU, which determine the basic parameters of the key institutes of private international law, and to analyze the case law of crucial importance for individual students in terms of their research area. Each of them focus on another area of ​​private international law. Analysis of selected case law will enable the student to better understand the areas of EU private international law he/she concentraces on. At the same time, new case law will be analyzed, as a significant amount is issued every year due to the expanding scope of EU private international law.
Learning outcomes
Students will perceive the case law of the CJEU on three levels relevant to each student. Firstly, at the level of basic, fundamental parameters of determining judicature, secondly at the level of case-law relevant to the field of their research, and last but not least at the level of the latest case-law.
