Course objectives
The course provides comprehensive knowledge of the issue of public property. This area represents the core of the so-called non-executive public administration, as a public administration that achieves its goals not by classical means of power (but rather by using relations and instruments of private law modified by public law). The course is therefore complementary to other courses focused on administrative law and public administration and contributes to the formation of a more holistic view of public administration and its legal regulation. The course focuses on the property law basis of the main categories of so-called public entities and also on some related current areas (e.g. the granting of subsidies).
Learning outcomes
Upon completion of the course, the student will be able to: - distinguish between different public entities (state, local self-government units, non-local self-government entities); - describe the nature and purpose of their property (economic) basis; - characterise public ownership (including giving examples of so-called public assets) and compare it with the ownership of private entities; - identify the differences between the acquisition, management and disposal of public property; - identify the basic way in which public property is acquired and disposed of; - identify the basic obligations in the management of public property; - distinguish the budgetary dimension of management; - describe the nature and purpose of subsidies and public procurement and the basic difference between them; - find solutions to simple cases in the field of state and local self-government units' property in the legislation.

  • 1/ Introduction to the Subject of Public Property and Public Ownership in Law and Society (definition of the area of so-called public property; specifics of ownership of so-called public entities; legal nature and purpose of public property and property rights; types of public property; so-called non-sovereign public administration); 2/ Office for State Representation in Property Matters (history, specifics, scope and activities); 3/ State Property (ownership and other property rights of the State and their exercise; definition of State property; acquisition, management and disposal of State property; liability); 4/ Property of other Public Entities - other than the State and the local self-government units (overview of selected public entities; definition of their property; selected aspects of acquisition, management and disposal of their property); 5/ Property of Local Self-Government Units (ownership and other property rights of municipalities and regions; definition of municipal and regional property; acquisition, management and disposal of municipal and regional property; liability). 6/ Provision of Subsidies, EU Cohesion Policy and Basics of Public Procurement (subsidies as a property law institute, legal regulation of subsidies - basic characteristics; background and problems of the so-called European subsidies - the EU and Czech law level; basic characteristics of public procurement).
