Course objectives
Students will analyse cases using actual and previous legislation so that they learn methods of interpretation above-standard and they understand legal institutes in a historical context. Students will gain practical experience related to methods of interpretation above-standard towards particular legal cases.
Syllabus
  • - Theoretical introduction, argumentation a historicam, sources of law - Iura in re (property, limitation of this right, iura in re aliena, evolution of institutes related to property included Usus modernus pandectarum, ABGB, de lege lata), liability in civil law - Law of obligation (evolution of institutes in law of obligation, especially Roman law heritage that is an integral part of actually prepared legislation). Types of legal actions, unnamed contracts - Heritage law (evolution of particular legal institutes, legal regulation of testaments, how to judge a testament in period of new legislation in force)
