Course objectives
The main objectives of the course is the understanding of the notion of sovereignty, as it is understood in international law, and its relation to the legal personality, from the following aspects: Notion of sovereignty in international and national law. State as a sovereign subject of international law, states with no full sovereignty, but with legan personality. Particular entities with incomplete sovereignty but with legal personality. Notion of the subject of international law (legal personality). Different understanding of the legal personality in international law, interrelation between legal subjectivity (personality) and the capacity to participate in international legal relation. Legal personality of EU.
Learning outcomes
- Student will be able to gain a deeper understanding of the fundamentals of legal subjectivity in international law, in particular that of states. - student will be able to identify the controversial points in the field of legla subjectivity. - Student will be able to critically think on which entites are/ought to be considered subjects of international law . Student will understand wider legal background of subjectivity, as well as theoreticla background on sovereignty.
