Course objectives
The course offers students the opportunity to study private law in a comparative context. Students will be able to use the acquired knowledge and experience, for example, in the elaboration of diploma theses, further studies (eg within the doctoral study program, etc.), or in legal practice. It can be considered that this ability (in combination with the student's language skills) can contribute, among other things, to the prospective employment of the student in the labor market after graduation. The course focuses on the sphere of private law, as there have been fundamental structural and content changes in this field in recent years. The legal regulation de lege lata is influenced in terms of content (among other things) by a number of foreign conceptual approaches and solutions, which are more or less reflected in it. The aim of the introduced course will be, among other things, to acquaint students with the sources of inspiration used in the preparation of recodification of private law, but also the importance of comparative law in the interpretation and application of new legislation and the direction of Czech legal doctrine. The teaching of the subject will use (to a limited extent, with regard to the sustainability of the project) and the experience of domestic and foreign experts who practice comparative law in the field of private law and have many years of experience with the use of comparative working methods. At the same time, the thesis is true that "comparative law is not taught, but done".
Learning outcomes
At the end of the course, students should be able to: Compare the individual approaches, particularly with regards to the differences between normative systems (ius commune vs common law), with special attention to selected jurisdictions. Identify common problems and trends. Assess new findings and ideas with a view of the long-term social consequences of their use. Communicate, in a comprehensible and convincing manner, their own findings in the chosen field to other students. Acquire new professional knowledge, skills, and capabilities through one’s own creative work. Think critically in broader dimensions and apply knowledge in new contexts.
