- Course objectives
- The main objective of the course is to (better) understand methods and means of dispute resolution in private law, outside the system of national courts. Students will learn how to identify appropriate techniques and procedures for resolving conflicts and disputes in particular cases. Emphasis will be placed on providing students with basis theoretical background building upon their knowledge gained in compulsory courses, particularly in law of civil procedure, as well as on learning how to apply theoretical knowledge to model cases from practice. The course is predominantly focused on solving of business disputes. However, attention will be given to all civil law disputes, including specific categories such as consumer disputes or solving of family conflicts. In terms of methods and techniques of dispute resolution, lectures will be devoted to arbitration proceedings and the use thereof in domestic (mainly commercial) disputes, and ADR methods, with emphasis put on mediation and conciliation being the one expressly regulated under Czech legislation.
- Learning outcomes
- After successful completion of this course, students will be able to:
- examine the model case situations and the nature of the dispute at hand (from the view point of possible settlement thereof)
- identify and interpret the given documents, contract provisions, etc.
- analyse the possibilities in terms of settlement of the given dispute within the limits established by the Czech legal order
- determine the techniques and procedures best suited in terms of the circumstances of the given case, and to explain why such procedure or the chosen technique suits the best
- define the requirements (preconditions) for implementation of the suggested procedure/ technique
- propose and draw necessary documents, or contract modifications in order to implements the suggested dispute settlement technique(s). - Syllabus
- 1. Introduction to civil law dispute settlement mechanisms. Basic terminology and overview of forms and techniques of dispute settlement in civil law (court proceedings, arbitration, ADR).
- 2. Basic characteristics and explanation of the nature of arbitration and arbitral proceedings (from the viewpoint of Czech legislation). Analysis of a mock case.
- 3. Arbitration agreement - examples, drafting and wording, pathological clauses.
- 4. Characteristics and nature of ADR and different types and methods of ADR techniques. Practical examples. Introduction to mediation and conciliation.
- 5. Mediation - analysis of the Czech Mediation Act. Practical issues and model situations. "Court-ordered" mediation under Czech law, other forms of interaction between court proceedings and mediators.
- 6. In case of interest of students, peculiarities of alternatives in solving of consumer disputes will be discussed in detail.

- Teaching methods
- Theoretical background - Lectures. Model practical cases. Class discussion. Homework. Individual projects - analysis of a model case. Presentations of the prepared case analysis during the colloquium.
- Assessment methods
- Class work and group discussions during the lectures. Homework. For the purposes of colloquium, students will prepare a case analysis of a given model situation (in writing). Each student will present his or her own case study orally during the colloquium, followed by a group discussion. Students have to attend and participate in 50% of the classes at minimum!
