- Course objectives
- The aim of the subject is in connection with the study of theoretical branches of the administrative law and the environmental law to increase the practical knowledges in the problematics of the monument preservation in the Czech Republic.
- Learning outcomes
- The student should be able in the final phase of the course to define characteristical principles, the legal frame and the public administration in the field of monument protection, also there should be a knowledge of types and evidence of the monument protection, furthermore to chracterize the sphere of archeology, renovation and preservation of cultural heritage including the law tools for the protection and the relation to the other parts of the legal framework.
- Syllabus
- 1. Basis of protection of cultural heritage, international and European legislation, principles; a practical example of protecting world cultural heritage - registration of a site on the UNESCO World Heritage List.
- 2. Legal framework of protection of cultural monuments in the Czech Republic - sources of national legislation, organization, categorization of cultural monuments and procedure of declaring cultural monuments, registration of cultural monuments, rights and obligations of the owner of cultural monuments and limitation of his rights, expropriation of cultural monuments, economic instruments, liability relations, discussion.
- 3. Conflicts of interests in protecting cultural monuments, tools of area protection, protection of cultural monuments under the regime of the Building Act and selected related legislation; model examples of conflicts of public interests, discussion.
- 4. Archaeological and palaeontological findings, protection of castles and chateaux, selected land-law relations; model examples, discussion.
- 5. Cultural monuments and protection of property rights, restitution regulations, the safety of sacred cultural monuments in the framework of restitution of church property; model examples, discussion.
- 6. Closing colloquium - presentation of colloquium papers and follow-up panel discussion on selected topics of monument protection.

- Teaching methods
- Orientation in practice skills : Explanation, reading and discussion during the lessons, also using of powerpoint presentations. Tasks for self studying, interactive analysis of the law regulations and precedents by using the eLearnig platform.
- Assessment methods
- The subject is finalized by a colloquium. The requirements for pasiing the colloquium will be preparation of the colloquial thesis and its defence and active participation during the lessons as well as elaborating of performances to the particular themas. In the case of not acomplishing the demands by the student, a substitutive compliance will be required.

- The compulsory literature is within the scope of chapter "I.9 Protection of cultural monuments", i.e. pages 360-393. The recommended literature is then as instructed by the teachers in the individual teaching blocks.
