- Course objectives
- The aim of this course is: - to acquaint participants who have not studied law at a law school in the past with the problems of establishing and exercising public authority and with the basics of the basic branches of law, which are constitutional law and administrative law. - Concerning the explained issues of national law, international law, and transnational law and the treatment of legal sources, an overview of the institutions of economic integration in the European Union and related measures, as well as of wider global integration, will be provided
- Learning outcomes
- After completing the module, participants should be able to:
• explain the functioning of the state, its bodies, and self-governing institutions
• discuss the importance of the constitutional foundations of the modern state
• understand the methods and forms of public law regulation, as well as the position of the individual in the sphere of public administration
• understand the system, functioning, and control of public administration with an emphasis on the principles of good administration and orientate yourself in terms of access to judicial protection provided by administrative justice
• understand the key institutions establishing international economic integration within the transnational EU as well as on an international scale
• be aware of the peculiarities of their anchoring, interpretation, application, and enforcement, which usually happen in cooperation with national law, but also often in conflict with it - Syllabus
- 1) Political science and constitutional law:
- the state, society and the position of the individual. The role and function of constitutional law
- the constitutional foundations of the state – especially the Czech Republic
- constitutional foundations of the legal system and public law regulation in modern states
- methods and forms of public regulation. Constitutional judiciary
- specific features of institutions operating between society and the state (political parties, interest groups). The right to self-government
- 2) Administrative law:
- subject of administrative law; methods and forms of regulation used by him
- legal order and public administration, public administration as an organization and as an activity; administrative code and principles of good administration
- legal guarantees in public administration, control of public administration and administrative punishment; Administrative justice
- 3) Law of the European Union II. - a special section focusing on economic integration:
- free trade in goods in the EU, possible restrictions on harmonization, tax aspects, customs union and external trade policy, partial liberalization by WTO agreements, free trade zones
- free movement of people in the EU, especially labor and personal freedom of business, regulation and control of migration
- freedom of establishment of commercial companies, free movement of services, capital and payments, protection and promotion of investments
- monetary union, control of the economy of the member states (including the management of the debt crisis) and the EU budget in relation to the budgets of the member states
- protection of economic competition with special emphasis on limiting state subsidies
- cooperation of authorities and courts in order to facilitate economic integration - area of freedom, security and law - summary from the point of view of business, emphasis on cooperation of courts in civil matters
