Course objectives
At the end of the course students should be able to:
- define the elementary institutes of the executory law;
- differentiate specifics of the executory proceedings according by the civil procedure code and executory code;
- draw up written motions addressed to the court or the court executor;
- draw up written decisions of the court or the court executor;
- analyze defects of executory law;
- solve complicated procedural problems;
- submit a proposal;
- interpret procedural acts;
- analyze the judicature;
- explain the importance of the procedural acts in the executory law;
- work in group
Syllabus
  • - institution of executory proceedings - motion
  • - writ of execution, service
  • - execution of judgement - sell of movable things and immovables, deductions from payrolls etc.
  • - executory contention - exclusive contentions, contentions against debtors debtor, stay of execution, lifting of the execution
  • - proceeds of the sale and its distribution - auction sale
  • - dismissal of the executory proceedings
