Course objectives
The objective of the course is to provide students with an introduction to contemporary issues concerning (gender) equality and discrimination. To this end, the course focuses on more general conceptual and socio-legal aspects of the protection against discrimination and the promotion of (gender) equality through law. By using a thematic approach, the course illuminates the key issues in discrimination law in general, while at the same time providing a brief overview of the specific legal context by referring to the legal framework of EU non-discrimination law and the prohibition of discrimination under the ECHR.
Learning outcomes
At the end of the course, students should be able to:
(i) understand the underlying values and principles of discrimination law;
(ii) outline the key concepts and enforcement mechanisms in the field of discrimination law;
(iii) interpret the most important contemporary issues concerning equality and discrimination in a social context.

  • 1. Theoretical framework and axiological foundations of anti-discrimination law
  • 2. Discrimination in the eyes of the law I.: Suspect classifications
  • 3. Discrimination in the eyes of the law II.: Conceptualising discriminatory practices
  • 4. Legal tools for tackling (gender) discrimination: Selected procedural & enforcement aspects
  • 5. Promoting (gender) equality beyond the prohibition of discrimination: The challenge of positive action measures
Literature
  • Materials will be distributed by the teacher before and during the lectures.

Lectures with in-class discussion.

Regular class attendance; active participation in discussion; short final take-home essay
