- Course objectives
- The course Theory of Law II (Methodology, Procedures) leads the student to acquire the ability to use general legal methodology, to know the reasons for the emergence of particular methods and techniques. The Theory of Law II course introduces students to the various techniques used in multiple interpretation and application of the law. It explains the terminology necessary to describe these methods.
- Learning outcomes
- Upon completion of the course, the student will be able to: • work with the concepts of legal language and specifics of legal language; • use the different techniques of lawmaking; • describe the process of interpretation of the law and distinguish different methods and techniques concerning the limits of their use; • explain the various steps of the process of application of the law, including subsumption; • identify the general requirements for truth-finding in the process of applying the law; • analyse the structure and content of legal argumentation; • name the necessary elements of the case law.

- 1. Drafting legislation. Substantive elements of drafting. Legal language. 2. Methods of interpretation of the law - linguistic interpretation. 3. Methods of interpretation of the law - systematic and logical interpretation. Teleological interpretation. 4. Case law. 5. Process of law application. Subsumption. Evidence. 6. Introduction to legal argumentation.

- Lectures. Practical exercises in seminars (solving model situations).
- Assessment methods
- It is necessary to obtain the colloquium to demonstrate practical knowledge and habits of application and interpretation of the law - this will be verified through a "clause work" in which the student demonstrates the ability to apply theoretical knowledge in solving a model case. The student's task will be to design and explain the example(s) procedures.
