- Course objectives
- The aim of this course is the analysis of the approaches to the determination of the law applicable to the merits of the dispute in international commercial arbitration, the critical evaluation of the approaches and the suggestion of suitable solution. Special attention will be given to the application of the conflict-of-laws rules of European Private International Law (Rome I and Rome II Regulations).
- Learning outcomes
- At the end of this course students should be able:
to identify and analyse existing approaches to the determination of the law applicable to the merits of the dispute in international commercial arbitration; to compare litigation and arbitration as regards this issue; to analyse the application of Rome I and Rome II Regulations in international commercial arbitration; to critically evaluate the existing approaches; to suggest the most suitable approach. - Syllabus
