- Course objectives
- At the end of the course students should be able to understand the basics of law-making in general and in the area of public administration in particular. They should understand the basics of legislative techniques necessary for the preparation of legal enactments in the field of public administration.
- Learning outcomes
- After finishing the course the students will be able to identify and explain the basic differences between the legal system and system of law and their elements (legal norm and legal provisions), then to differentiate between the terms of the legislation, law-making, norms-making and the theory of legislation, including its components. They will be able to explain the meaning of the law for the functioning of the State and the status of the individual and its relationship to the law of the European Union. They will be able to describe the constitutional and legal regulation of the process of law-making on the state level and the level of the territorial self-government. They will also know the internal rules for the law-making such as the Legislative rules of the Government, the Regulation Impact Assessment , Corruption Impact Assessment, Discrimination Impact Assessment etc. The students will be able to explain the scheme of the legal enactments and the importance of the individual components of the scheme. They will know the main conclusions of the Constitutional Court on the constitutionality of law-making.
- Syllabus
- 1) Introduction to the law-making theory in the Czech Republic and in the world. The law-making as a set of legal norms and internal instructions. Basic practical aids of legislator. Legislative rules. Legislative methodology. Legal informatics and law creation. 2) Basic notions. Law-making, laws and other legal enactments. The validity, effectiveness, applicability. Types of secondary legislation. Systematic use of the rule of law. 3) The concept of law-making and its principles. Customs, findings and created law. Legislative power at the level of public administration. The content of the principles of the formation of secondary legislation. The mechanism of the law-making. Authorities with legislative powers, and other bodies. 4) Legislative technique: Content, form and depth of regulation. The choice of form of the law. Reception. Reference. Footnote. The general clauses. Indeterminate notions. Legislative discretion. Legal language. The special features of the secondary legislation. 5) The choice of concepts and wording of the enactments. Legislative abbreviations and shortcuts. Full, abbreviated, and verbal citations. Foreign words. Enumerations. Marginal notes and headings. Legislation in time. Republication. 6) Preparation and adoption of legislation: the processing of the proposal and its adoption as a process. Explanatory memorandum. E-Library of government bills.
