- Course objectives
- The aim of the course is to provide a theoretical basis for the issues of construction law from the public law perspective, including current changes in the context of the reform of public construction law. Within the scope of this course, attention will be focused on the explanation of the basic concepts of public construction law, individual procedures of construction authorities according to the Construction Act, with a focus on the regulation of the building code, etc. Furthermore, attention will be paid to the reform of construction law from the perspective of builders and from the perspective of administrative authorities.
- Learning outcomes
- At the end of this course students should have a basic theoretical and practical knowledge of the public and private law governing construction law. Students should be able to explain the connections and relations between construction law and administrative law, to apply legislation on various practical examples, to offer a solution of specific cases and is able to justify his solutions.
- Syllabus
- 1. Introduction. The concept of "public construction law" and sources of legal regulation, characteristics of the current state of legal regulation. Organisation of administration in the field of public construction law. Building authorities. 2. Reform of public building law. 3. Introduction to spatial planning. Processes in the framework of zoning procedures, simplified procedures. 4. Permitting of building plans, specifics, simplified procedures. 5. Approval of buildings (putting buildings into use). 6. Demolition of buildings. Sanction proceedings under the regime of the Building Act.
