Course Enrolment Limitations
The course is offered to students of any study field.
Course objectives
The course deals with non-contractual obligations from the perspective of conflict-law rules. Both traditional connecting factors as lex loci delicti or lex protectionis together with newly usead freedom of choice together with its limitations will be analized. Also overriding mandatory rules and safety rules will be discussed. In terms of sources, both the Rome I Regulation and the relevant parts of the Czech PIL Act.
Learning outcomes
After completing the course the student will be able to explain the basis and doctrines concerning the traditional conflict-law solution of non-contractual obligations, explain the position of freedom of choice, explain conflict-law solution for selected special torts and analyze overriding mandatory rules and safety rules.
