- Course objectives
- The aim of this course is to familiarize students with historical development, various concepts and valid legal regulation of the administrative justice. The cemphasis is on the analysis of the Code of Administrative Justice Procedure and related regulations.
- Learning outcomes
- At the end of this course the student will be able to: Understand to basic concepts and institutes and explain them in the historical context; Use the information about the concepts and institutes of the admistrative justice to solve concrete procedural situations; Make independently some pleadings; Bring reasonable suggestions of solving the procedural situations; Apply the procedure law to concrete procedural situations; Interpret the procedural regulations in line with the judicial practice.
- Syllabus
- Notion, function and subject of administrative justice; distinction between public administration and justice; basic conceptions of administration justice.
- Historical development of administrative justice; current regulation of administrative justice in some foreign countries.
- Administrative justice, its organization and its procedural regulation in the Czech republic (Czechoslovakia) from 1918 to 2002.
- Revision of the administrative justice in the Czech republic - reasons and conditions.
- Organization of administrative justice.
- Analysis of the Code of administrative justice (law. no. 150/2002 Coll.) and relating case law.
- Proceedings according to the V. part of the Civil procedure code.
