Course objectives
At the end of the course the students should be able to: understand and apply both substantive and procedural provisions governing alternative dispute resolution; write a complaint against a cybersquatter under Uniform Domain-name Dispute Resolution Policy; write a response to a complaint under Uniform Domain-name Dispute Resolution Policy; write a contract regarding the transfer of the domain name; understand wider regulatory framework of on-line marketing, understand the sector specific regulatory framework of on-line marketing; understand wider application and use of online dispute resolution tools.
Learning outcomes
The student will be able to write and submit an electronic complaint or response through specialized UDRP platform. The student will be able to apply the provisions of administrative, civil, EU and international law to problems related to domain names, internet marketing and internet governance; the student will be acquainted with wider application and use of online dispute resolution tools.
Syllabus
  • Introduction, scope of the course and basic issues; Domain name as a service or property, transfers of domain names; Introduction to alternative dispute resolution and ODR, domain names within the .cz domain and .eu domain; Contract drafting skills; UDRP Case-Law; Procedural elements of alternative dispute resolution; Wider regulatory framework of on-line marketing; Targeted online marketing; New forms of online dispute resolution / online courts; Practical experience; Elements of unfair competition and personal rights, comparison of UDRP, Czech rules and EU rules; Moot Court.

Assessment methods
Students will have to take part in a simulated UDRP procedure as complainants or respondents. They have to submit their complaint or response (4-8 pages long) in writing through specialized online platform and present their work in the class.
