Syllabus
  • Mezinárodní právo veřejné - obecná část International Law - General Part 1. International law as an active reflection of the global international community. The influence of multi-centric and multi-cultural nature of societas maxima. 2. Personality in international law. The State in Bermuda Triangle: territory, population and sovereignty. Self-determination in the political and legal context. Particular legal entities. 3. Institutionalisation of the international system. International intergovernmental and supranational organisations as persons of international law. 4. The lack of hierarchy and autonomy of the sources of international law. Interpretative reading of Art. 38 of the Statute of ICJ. Positives and negatives of international treaties. 5. Static and dynamic analysis and findings of custom in theory and practice of international law. The new understanding of "usus longaevus" and "opinio iuris". 6. Certainty and uncertainty of general principles of law and their application in the international order. Independent unilateral declarations of states and acts of international organisation. 7. Dispositive and imperative norms in general international law. Fast development of particular (regional) regulation. 8. Relation between international and municipal law. Domestic and international views on dialectic relationship. Anemia of the Constitution of CR. 9. Responsibility (ex delicto and ex contractu) in international law. Consequences of responsibility: cessation, restitution, compensation, satisfaction and promise. 10. Decentralised and centralised mechanism of enforcement in international law. The restrictive conceptualisation of counter-measures and the UN collective system of security.
