Course objectives
Anglicky: Main goals of this course are following: to deepen knowlege of such branches of law as theory of law and philosophy of law; to clarify the framework of legal argumentation and other problems of theoretical legal thought; to specify the usage of selected methodological procedures of legal understanding and argumentation by means of both theoretical and practical examples; to learn the lege artis methodology of applied teleological interpretation and the principle of proportionality; to consider rational reasoning of moral judgment by means of discourse analysis (ethical criteria of legal argumentation); to outline the algorithmic rule how to solve the situation of conflict of purposes of law. At the end of the course the student shall be able to: - understand the framework of legal argumentation and arbitrariness, - use selected methodological procedures of legal understanding and argumentation by means of both theoretical and practical examples, - apply the lege artis methodology of applied teleological (purposive) interpretation, - compose rational reasoning of moral judgment by means of discourse analysis (ethical criteria of legal argumentation), - construct algorithmic rule to solve the conflict of purposes of law .

  • 1. Introduction to legal reasoning (basic concepts, theoretical background) 2. Legal hermeneutics and legal argumentation 3. Trying legal cases (structure, soft and hard cases etc.). 4. Interpretation and its methods. 5. Teleological interpretation and the proportionality principle 6. The role of judicial ruling in the Czech legal system (independence of judiciary, case law etc.).
