The prerequisites for students are a genuine interest in the subject, regular preparation (so that we can devote the class to skills practice), the ability to think inventively and a high level of analytical skills.

Course objectives
administrative law as dealt with by the Ombudsman. The lawyers from the Ombudsman's Office will use the case studies to demonstrate the nature of the work in the Ombudsman's Office and possible legal solutions to cases. Students will solve practical cases from the field of administrative law that offer guidance on how to handle situations in practice. During the six seminars, we will guide the students through an introduction to the Ombudsman's competences, the way of working and the general principles of his/her work, as well as through the different sub-areas of administrative law. For each unit, the emphasis will be on practical skills training and practice of the range of activities encountered by the Office's lawyers (complaints, investigations of the Ombudsman and their outcomes, preparing comments in the legislative process, etc.).
Learning outcomes
Upon completion of the course, the student will be able to: - identify problems in legislation and practice - provide legal argumentation - find solutions in teams - critically analyse legislation in selected areas.
Syllabus
  • 1. Consumer protection - definition of the consumer, consumer protection under legislation (sale of goods in shops, telecommunications, energy) + possibilities of supervisory authorities. 2. Public roads - definition of the terms road, private road, public road, land road. Competence of road administrative authorities vs. general courts. Types of proceedings. 3. Administrative punishment - legal regulation, major vs. minor punishment, basics of administrative punishment (culpability, formal/material features), principles of procedure. 4. Right to information - the content of information, the dismissal of requests, legal remedies, and types of information that cannot be disclosed. 5. Execution of decisions. 6. Municipal regulations - differences, rule-making process, collection of legislation, supervision of the process and the Ombudsman´s cases in the Constitutional Court.
Teaching methods
Solution of model situations, practical examples and case studies, class discussion.
Assessment methods
regular attendance (with the possibility of one absence), active involvement in the class and completion of assigned tasks (two assignments with feedback).
