- Course objectives
- The course describes the reflections and processes of institutionalisation of international law that appeared already in the second half of the 19th century and acquire their striking power in respect of postmodern global international community. International organisations reflect not only on the public interest in international law but also have become a modern medium and vehicle of international law-making. The course includes the analysis of two institutions that represent universal and regional (European) levels: the UNO and the Council of Europe. The UN has primarily originated as the "machinery for peace". Its institutional weaknesses appear in everyday confrontations with the situations that endanger international peace and security. Moreover, the "powerful basis" of the organisation reflect the international stimuli after World War II and does not take the current structure of "societas maxima" into consideration. The course aims especially at the issues of peace and security and possible individualisation of these social values. The Council of Europe and its law-making role as an effective device for conventional instruments is emphasised for complying with the harmonisation purposes in Europe that shares the rule of law, respect for human rights, pluralistic political system and democracy.
- Syllabus
- THE TOPICS FOR THE SPECIAL PART OF INTERNATIONAL PUBLIC LAW: 1. The legal concept of "terra nullus" in the course of time and the demand resulting from ocular, symbolic and effective occupation, uti possidetis, geographical continuity, geological contiguity, etc. State territory, territorial sovereignty and administration in international judicature. 2. Characteristic features of the modern law of the sea. Symbiosis of national and international regimes (internal waters, the territorial sea, the contiguous zone, archipelagic states, exclusive economic zone, the territorial shelf, the high seas as res communis omnium and the international sea-bed as the common heritage of mankind). 3. Bifocal point of view at the character and legal regime of the Antarctic in the consideration of two experts. 4. Different forms of diplomacy, the basics of diplomacy law, diplomatic privileges and immunities and the personal, territorial, temporal and material scope of applicability. 5. State nationality and its connection with international law. Understanding nationality from the human rights point of view. The right to have, change and not to be arbitrarily deprived of nationality. 6. Gradual and fast changes of international humanitarian law and its current reflection, its principles as normative vectors. 1. The UN Charter as a "living" international instrument. Superiority of obligation according to the Charter over other treaty obligations of the members. 2. Preamble to the Charter, its significance, aims and principles of the UN and the linguistic, systematic and teleological reading. 3. Organisational structure of the UN. The General Assembly as the body representing the UN in the connection with the following aspects: structure, powers, competence, negotiating and passing recommendations. 4. The Security Council as the operational, political body of the UN and its binding and non-binding acts. 5. Peace operations of the UN as vital (or ineffective) means for maintaining and making the world peace. 6. Spectrum of non-armed sanctions of the UN Security Council pursuant to Article 41 of the Charter and their evolution. 7. The analysis of armed operations in Korea and Kuwait according to Chapter VII of the UN Charter and their dichotomy.
