Course objectives
The course is aimed to elaborate knowledge from the courses MP504K International Private Law I. and MP604Zk International Private Law II. This course has the following objectives:
to be able to identify the problematic parts of the international and the european international law of insolvency;
ability to solve the relationship between sources of international insolvency laws;
to analyse the jurisprudence on the cross-border insolvency (in particular the question of the center of the main assets of the debtor);
Syllabus
  • Unification of the international incolvency law in the world and Europe and its real limits.
  • System and scope of the european insolvency law.
  • Recognition and enforcement of insolvency proceedings and decisions issued within.
  • Cooperation between the courts of the Member States.
  • Conflicting insolvency law.
  • The position of creditors and protection of specific groups of persons.
  • Motion for the recognition of insolvency decisions and their enforcement.
  • Trustee, his status and privileges.
  • Implementation of legal aid in the frame of insolvency proceedings.
  • Evidence held in the framework of international insolvency proceedings and the principle of publicity.

Teaching methods
lectures, reading of the materials in the interactive tool, followed by practical examples, exercises and discussion in class (hypotheticals), homeworks (drafting model answer of a hypothetical case)
Assessment methods
Requirements for colloquium: continuous evaluation of the performance of the tasks assigned at the time of teaching in the semester.
At the end of the semester students analyse a selected problem, which they defend in an oral debate .
