- Cíle předmětu
- At the end of the course students should be able to:
clarify the similarities and differences between the approaches within the study of International Business Law and European Law;
explain the reaching of an agreement;
list the stages of preliminary negotiations;
explain the difference between breach of contract and tort;
understand and apply the provisions of the EEX Regulation (Brussels I);
understand and apply the provisions of the ECO – Regulation (Rome I);
reproduce the most important characteristics of the Convention on the International Sale of Goods (CISG) and apply it;
explain the contract of carriage;
explain and apply Incoterms and international payments - Osnova

- Course description: When a company wants to enter a foreign market in some country it has to consider all the relevant aspects, including the legal aspects of this country. This course provides students with an overview of the structure and nature of International Private Law and EU Law, such as the international sale of goods, the supremacy of EU law over the national legal orders and the principle of direct effect. The legal aspects of negotiations in the pre-contractual phase are discussed and the options to claim damages of a party that broke off the negotiations. After the contract has become final, three legal provisions, each one connected to international treaties and regulations are discussed. In order to fulfil an obligation of delivery resulting from an international sales contract the issues concerning carriage of goods, limitation of risks and international payment are also topics in this course.
