Course objectives
This course is specifically designed to give students hands-on experience in the application of the rules of criminal procedure at the state court level in the United States. As such the course will provide insight into the use of the rules of criminal procedure as tools to ensure constitutional protections are provided in the daily operation of the state criminal courts. Actual state court records of two murder trials, will be used as examples of the application of specific rules of criminal procedure.

The constitutional authority for each rule of criminal procedure will be shown and discussed.
Syllabus
  • 1. Fundamentals: focus on state criminal procedure; Kentucky and Ohio Rules of Criminal Procedure; Common Law Crimes Abolished; No Ex Post Facto Law; Rules of Construction.
  • 2. Arrest and Probable Cause.
  • 3. The Grand Jury.
  • 4. Arraignment, Motions and Discovery..
  • 5. Trial by Jury: Jury selection, juror challenge for cause, peremptory juror challenge.
  • 6. Trial by Jury: Order of Proof; Direct Examination, Cross examination; Opening/Closing Argument.
  • 7. Trial by Jury: instructions to the jury; final argument.
  • 8. Trial by Jury: verdict, appeal. Examination.

Assessment methods
The exam will count for half the grade and will consist of 25% multiple choice and 25% one essay question; the other 50% of the final grade will be based upon attendance and participation in class.
