- Course objectives
- At the end of the course students should be able to:
have basic theoretical as well as practical knowledge of the law-making of regions and communities (thus about regional and local law), with its historical background and legal regulations in other European countries;
understand and explain the relations among national, regional and local law;
apply law on different practical examples and suggest a solution of propounded case studies including giving reason for the solution;
propose elementary local/regional legal regulation;
evaluate lawfulness/unlawfulness of local/regional legal regulation. - Syllabus
- Legal basis of position of territorial self-governing units in the Czech Republic. Law-making of local and regional self-government in democratic legal state. Historical development of local and regional self-government law-making on Czech territory. Communal legislation in the Czech Republic - bylaws of communities, generally binding communal ordinances (legal regulation, passing and particular delegation). Regional legislation in the Czech Republic - bylaws of regions, generally binding ordinances of regions (legal regulation, passing and particular delegation). Local and regional law-making state supervision – solution, legal regulation and public administration practice. Topical problems of Czech public administration practice linked with realization of law-making competences of local and regional self-government and current development of legal regulation. Legislation of local and regional self-government in the Constitutional court decision. Law-making of local and regional self-government in surrounding European states.
