Prerequisites
In order to take the state exam, it is required to fulfill all studz requirements of the doctoral programe Law of Information and Communication Technologies.

Course objectives
The purpose of the exam is to verify the compliance of doctoral thesis with legal requirements and to proof required level of knowledge of the applicant in ICT law, all pursuant to the Higher Education Act.
Learning outcomes
The outcome shall be the evaluation of doctoral thesis, the evaluation of oral exam and overall result of the state exam.

  • Concept of virtuslisation, concept of actualisation
  • Concept of information, concept or organisation, law as information system
  • Territoriality of law and information sovereignty of state
  • Positivist, pragmatic and naturalist methodology of ICT law
  • Formalisation of law and recent issues in legal informatics
  • Algorithmic application of law
  • Virtualisation in promulgation of law
  • Code as normative utterance of definition authorities and its relation to black-letter law
  • Regulatory structure of the Internet
  • Freedom of information and its presence in applicable law
  • Free speech and its protection by positive law (incl. international comparison)
  • Regulatory phenomenon of domain names
  • Subjects in ICT law, legal existence of autonomous systems
  • Informational self-determination
  • Privacy protection through instruments of private law
  • Personal data and legal means of their protection
  • Legal regulatory framework of cross-border data transactions (personal data, scientific data, intellectual property etc.)
  • Non-distributive information rights
  • Concept and structure of cybersecurity, recent regulatory approaches
  • Cybersecurity incident and use of force (incl. attributability)
  • Information feudalism and information anarchism
  • Economic relevance of data and protection of their value
  • Abuse of IP, abuse of market dominance in ICT

Literature
  • Literaturou ke zkoušce je souhrn literatury v profilových kursech.
Teaching methods
This course does not include any teaching. It is meant as an administrative unit for credit evaluation of the state exam.
Assessment methods
The state exam consists of a defence of doctoral thesis and an oral exam. Doctoral thesis is defended in front of a standing committee or an ad hoc committee. The applicant makes an oral statement about his or her research, the thesis and its conclusions. The applicant's statement is then followed with a discussion based on evaluation reports and questions of the members of the committee. Regular time of the defence is approx. 60 min. The oral exam is taken in front of a standing committee or an ad hoc committee. The exam consists of answers to questions directly asked by committee members. Regular time of the oral exam is approx. 60 min.
