Course objectives
Students will get acquainted with the definitions, principles and application of restorative justice. They will learn what probation activities involve and get acquainted with the process of victimization.
Learning outcomes
1. Students will receive basic knowledge about theoretical foundations, principles and goals of applying probation and mediation in criminal justice.
2. Student will understand the current state of applying alternative resolutions of criminal cases in practice with the emphasis on specifics of social work in criminal justice.
3. Students will be able to resolve independently specific cases using the Criminal Code and the Code of Criminal Procedure
Syllabus
  • 1. Overview of the history of punishment European prison systems and reasons for searching for new forms of societies’ responses to criminality. Comparing retributive and restorative justice concepts Explanation of the terms probation and mediation.
  • 2. The Probation and Mediation Service of the Czech Republic – the foundation, historical development, set-up. Clients – offenders and victims. Cooperating institutions Act 257/2000 Coll. about the Probation and Mediations Service. Historical development of the probation service system in the Czech Republic.
  • 3. Activities of the Probation and Mediation Service of the Czech Republic within criminal proceedings. Mediation as a general method of conflict resolution. Mediation as an alternative way of achieving criminal justice. International comparison of mediation models.
  • 4. Applying mediation in the activities of the Probation and Mediation. Service of the Czech Republic – principles, rules, methodologies. The influence of mediation on criminal proceedings. Other activities of the Probation and Mediation Service of the Czech Republic during pre-trial proceedings.
  • 5. Community service order as a community sanction Legislation, methodologies, specifics of community service order. Current situation in applying community service order in practice. Statistics.
  • 6. Probation supervision as an example of a long-term cooperation with a client. Legislation, methodologies, specifics of probation supervision. Evaluation of applying probation supervision in practice.
  • 7. Parole – preparing information/resources for parole release from prison sentence. Cooperation between the Probation and Mediation Service of the Czech Republic and the Prison Service of the Czech Republic. Methodologies, statistics.
  • 8. Main characteristics of juvenile delinquency. Juvenile delinquency in statistics Act 218/2003 Coll. – Juvenile. Criminal Law.
  • 9. Experience with applying the Juvenile Criminal Law. Specifics of working with juvenile delinquents and minors. Probation programs for juvenile delinquents.
  • 10. Changes in the activities of the Probation and Mediation Service in relation to the new Criminal Code applicable from January 1, 2010. Alternative punishment of home detention. Alternative punishment of a ban on participating in sport, cultural and other social events.
  • 11. Victims – special type of social. Work in criminal justice.
  • 12. Work with casuistries.
