Course objectives
The course deals with conflict of laws in the area of contracts. The institutes of choice of law, restriction of choice, substitute law, imperative rules will be discussed. In terms of sources, both the Rome I Regulation and the relevant parts of the ZMPS and the Rome Convention will be analyzed. Students will work in general with the given standards, and individually will focus on selected institutes in this area of ​​private international law.
Learning outcomes
At the end of the course the student will be able to: - analyze the various sources of legislation; - analyze the choice of law, indicate its sources, limitations, etc. - explain the doctrines concerning the choice of law; - explain ways of alternative solutions in the absence of choice of law; - analyze mandatory standards (imperative rules); - draw up a comparative-type study in the area of the choice of law.
